Vote Smart: He's Out of Jail!

I know that PinkDome's huge Libertarian readership has been very concerned about this, so I'm happy to pass along the good news: Phil Smart, the Libertarian candidate for Kip Averitt's state senate seat, has been released from an Ellis County jail just in time for the election. I know, right? Huge sigh of relief!

I know y'all follow Libertarian politics in Ellis county very closely, so forgive me for rehashing what you already know. Smart was serving time for a probation violation that stemmed from a 2004 assault charge. In 2004, police records show that Smart pulled a knife on some Wells Fargo employees, then put the knife to his own wrist and asked the tellers if they wanted to be "blood brothers."

Bryan Eppstein, a campaign consultant for Sen. Averitt, comes with the money quote:

"Libertarian candidates generally pull 1 to 2 percent in a three-person race, and because there's no Democrat running in this race, I don't think it's a positive thing for the Libertarian candidate to get arrested," Eppstein said. "Laws apply, even to Libertarians."
Such insight.

Let's hope that all the libertarian uproar over Smart's situation can lead to some changes in the law - where people don't get in trouble for pulling knives on bank tellers then threatening to cut their own wrists. I mean, where's the justice? Damn you, big government!

There was no assault; the two women who filed charges never even saw him that day. The teller he saw and who closed his account at his request was never referenced. Phil is a CPA. He underwent an investigation by that board that entirely exonerated him on the basis of the records he keeps meticulously. I am going to write up the story using those documents next week.
