A Few HD-32 Notes
  • Another great article, this one from the Texas Observer, on Juan Garcia's campaign to unseat Count Seaman.

  • A lifelong Republican in Corpus Christi filed an ethics complaint against Count Seaman over his use of campaign funds to pay for the rent on his Austin condo. Basically, Seaman's argument is that the whole scheme is kosher because the condo is his wife's separate property. The complaint says: prove it, because after 50 years of marriage, chances are pretty damn good that there's little separate property in their relationship. The lawyers in the article tell us:
"Unless the parties involved can show evidence that the funds paying for a particular asset were a gift, inherited or owned at the time of marriage, it is presumed to be community property," [a local lawyer, board certified in family law] said.

If Gene Seaman provided his wife with the funds to buy the condo, it would constitute a gift and would be viewed as community property, lawyers said.

So prove it, Seaman. Or has your bluff been called?
