I’m afraid it’s a bit late to alert Talton. Justice Rehnquist already ruled that the phallic tilework can stay:
“No exact formula can dictate a resolution to fact-intensive cases such as this. Despite the phallius’ sexual message, an inquiry into the context in which the image of the phallus is used demonstrates that the phallus also conveys a nonsexual message about proper standards of social conduct and a message about the historic relation between those standards and the law. The circumstances surrounding the phallus’s placement on the capitol grounds and its physical setting provide a strong, but not conclusive, indication that the imagery as used conveys a predominantly nonsexual message.”
A that message would be … the legislative salute to the citizens of the State of Texas.
